Nvidia Corp. is nearing a significant lobbying triumph after U.S. lawmakers decided not to include a controversial measure in the must-pass defense legislation. The proposed policy would have limited the company’s ability to sell its advanced AI chips to China and other adversarial nations.

The measure, known as the GAIN AI Act, would have required chipmakers, including Nvidia and Advanced Micro Devices Inc., to prioritize American customers for access to their powerful AI hardware before any sales to China or other sanctioned markets. Lawmakers had aimed to push this proposal forward as part of the annual defense policy bill, which was slated for release on Friday. According to a person familiar with the bill, the provision is not currently in the legislation, though changes could still occur before final passage.
